Chelmsford Man's Lawsuit Against Lowell Police Continues

A Chelmsford man injured in a 2010 fight by police will not have his lawsuit thrown out of court.

The Lowell Sun reports that a lawsuit issued by Chelmsford man injured by Lowell police who subdued him in a brawl will hear its day in court.

U.S. District Court Judge F. Dennis Saylor denied a motion from the City of Lowell asking to dismiss the lawsuit, which said police used excessive force in subduing Andrew Bochart, who suffered additional pain on recent arthroscopic repair of his left shoulder after being drawn into an incident at Hookslide Kelly's in Lowell in August of 2010.

Bochart was arrested by Chelmsford police in June for two counts of alleged assault and battery.
