With the fire station out of the way, Town Meeting will continue tonight starting by taking up article 11.
Town Meeting reps will decide on:
- Replacing the venting systems at select schools
- A plan to appropriate $1.7 million for the Department of Public Works Alpha Road building
- Using money from Community Preservation to restore the 1802 Red School House off Westford Street and the Middlesex Canal Toll House
- Using Community Preservation money for the restoration of gravestones at Riverside Cemetery
- The scenic road bylaw

If I read the warrant article correctly the Planning Board can designate any road as scenic. I also don't see any wording that specifies exactly how this article doesn't infringe on private property rights. There isn't anything defining the Town's "Right of Way" in a way that makes it clear where owner's rights begin and the Town's end. From what I read, the Planning Board could prevent me from taking any tree that is a danger to my home, family, or property no matter where that tree is located on my property. A member of the Planning Board has stated "These same trees are subject to the "Shade Tree Act" which requires a public hearing for the same work as covered by this proposed by-law." My question then is why the need for this bylaw? If Town Meeting votes this article down, the Shade Tree Act will still apply and remain unchanged. Therefore, as I see it, the proposed article is only another infringement on property owner rights and should be voted down at Town Meeting. It's another example of how local politicians want to control how you maintain your property. Anyone who has ever been through the Planning Board's property variance process will understand how this article is not in the best interest of Chelmsford homeowners.

Tony- I hope you had a chance to watch town meeting last night to see the presentation that hopefully answered your questions. Hearing comments in advance of town meeting enables the presenters to make sure they have answers. Keep in mind that public hearings on all zoning and planning board articles are held within 4-6 weeks before town meeting and they are open to all and will give you a forum to ask your questions directly.
(FYI- variances are granted by the Board of Appeals - not Planning Board)

I agree with Tony. We dont need any more government coming onto our properties telling us what to do! When they pay the taxes on our land then they can have a say. thanks.
